it is an intentional software design flaw
My 2011 M37 does exactly this. I received a letter from Infiniti a couple of weeks ago informing me of a complimentary software update to add the call waiting feature. Their letter basically acknowledged numerous complaints. Hopefully a fix is also available for the rest of the 2011 Infiniti lineup.
The response I got early on from the dealer was useless. Infiniti is extremely slow to fix mistakes they have made, and it's surprising how many they let slip into production vehicles. My M's transmission software was abysmal, and it got all the car magazines to slam the transmission in early reviews. Why they release half baked software, I don't know.
