Buying Used 2011 QX56 (Title Question)

Ok. I went to see the truck and it was awesome (no noticeable gas pedal vibration). We agreed on a price and everything is good.

Now, the seller has to pay the car off (over $57K). I was there while he placed a called to Nissan Finance. I heard the representative say that after the car is paid off, she can have the title sent in anyone's name (mine). From what I understood (since he already paid taxes on it when he bought it), they can send the pink slip in my name, without paying title/tax fees. Is this a true statement, or am I crazy? Please let me know. Thank you all!
 
What state are you in? I have done similar auto deals in CA. Once the loan is paid off the the finance company or DMV usually sends the title to the person that financed the vehicle (seller). Once the seller receives the title they should sign over the title to you or your finance company and hand it over. Per the DMV the seller is the one that will send in the title transfer doc. Once the DMV receives it they will send you a title in your name or the send to the finance company. In CA you will end up paying tax on whatever the seller lists as the selling price on the transfer doc. I've heard of some people fudging the selling price number on the title transfer to avoid paying higher taxes. That is up to you and seller and accepting the risk involved in doing this. By the way, you mentioned in another post you were going to buy this in the low $40k range. Is the seller paying the difference on the loan to pay off in full? He is not going to be able to make a partial payment to satisfy the loan and get the title.

Thanks again for the reply maverick415. It is the same truck. The seller is paying off the balance in full (almost $15K). I am in California. I'm paying in full, in cash (cashier's check).

You said the finance company or the DMV usually sends the title to the person that financed the vehicle. I specifically heard the representative say that the seller can specify who should be named on the title, and where it should be sent. She made it seem like sending him the title in his name was unnecessary, and it could be sent in my name directly; instead of having it sent to him, then him having to sign it over to me. I'm basically trying to avoid paying outrageous CA taxes =). Will the method of having it titled to me directly (bypassing him ever having it titled in his name), achieve my goal? You can try. As far as I know the DMV is the only one with authority to title the vehicle to anybody. Sometimes finance companies hold electronic title and the DMV mails a paper copy. I would be surprised if the finance company can produce a title in your name. The DMV will need to be notified via a title transfer doc. On that doc is the selling price of the vehicle. If you're paying cash the amount you specify, which will be subject to CA tax, is up to you and the seller.

Also I'm just curious why the seller wants to sell a vehicle where they would need to cough up an additional $15k or so to satisfy the loan? That seems like a red flag to me that needs exploring.
 
I'd pass on this Tone... I financed my QX and the title is in MY Name, and I have the title in hand, though Infiniti finance is listed as a LIEN HOLDER.

No way in heck is some guy sell it to you and gonna take a $15k hit. RED FLAG!!!. If he could afford to do that, he'd paid cash for it in the first place. Best thing to do, is to have him pay it off first, get the title in his name. And then you can buy it from him. You're being SCAMMED! Call Infiniti Finance yourself. Get the VIN NUMBER of the truck and the guys name, and ask them to verify ownership.

Also... I'd make him give u a copy of his driver's licenses.

Sorry for the late reply guys. I did NOT go through with that deal. The guy wasn't scamming anyone though. He was totally legit. He ended up calling me later that night, and said that his current financial situation didn't allow for him to take that $15,000 hit. I just wish he would've figured that out before I drove nearly 3 hours (round trip). He was a very nice guy, just not that savvy with finances.

Also, I just pulled the trigger (today) on a 2011 Liquid Platinum (favorite color) QX56, with 23,700 miles (not CPO/MBZ dealer), with Wheel & Tire Package and Deluxe Touring Package, for $47,400.

I'm happy with the deal and am thinking about adding an "Elite Extended Warranty" (right before it reaches 30K miles).
 
Congrats! Where did you buy it? My local dealer just put one up for sale that sounds exactly like this.

Let me guess. It has 25K miles and doesn't have the Deluxe Touring package and is at Niello Infiniti in Concord. Right? I was close to buying that one until I saw the one I ended up buying from MBZ of Orlando. Yes...Florida. I know it's far, but shipping will only be around $800 (uShip), and it has the Deluxe Touring package (which I really wanted). It comes out to be the same price I negotiated with Niello (factoring in taxes shipping etc.), and has less miles (23,700). I know there's no CPO on it, but really; CPO only extends the power train warranty to 100,000 miles from 70,000. I found this out after much research. Very misleading and deceptive on Infiniti's part. Plus, I want to add an "Elite Extended Warranty" right before the odometer hits 30K miles, so no big deal at all.
